DMCA Policy
Sweet Potato Salad respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Sweet Potato Salad will respond expeditiously to claims of copyright infringement committed using the Sweet Potato Salad service and/or the Sweet Potato Salad website (the "Site") if such claims are reported to Sweet Potato Salad's Designated Copyright Agent identified below.
This policy describes the information that should be present in a DMCA notice to Sweet Potato Salad and outlines the process for copyright holders to notify us of alleged infringement, as well as the process for users to submit a counter-notification if they believe their content was removed in error.
Filing a DMCA Notice of Alleged Infringement
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Sweet Potato Salad's Designated Copyright Agent. Upon receipt of the Notice as described below, Sweet Potato Salad will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, and information reasonably sufficient to permit Sweet Potato Salad to locate the material.
- Information reasonably sufficient to permit Sweet Potato Salad to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please send the completed DMCA Notice to our Designated Copyright Agent via our contact page, specifying "DMCA Copyright Claim" in the subject line or message body.
Filing a DMCA Counter-Notification
If you believe that your User Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your User Content, you may send a counter-notification containing the following information to Sweet Potato Salad's Designated Copyright Agent:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and an e-mail address.
- A statement that you consent to the jurisdiction of the federal court in [Your State/Country, or the closest applicable jurisdiction] and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
